11.3 Before participating, all members must provide written consent acknowledging their understanding of the nature of breathwork and ice bath programs, including potential physical and psychological effects.
11.4 We strongly recommend participants seek professional medical or psychological advice before joining breathwork or ice bath sessions, especially if they have pre-existing health conditions or concerns. The programs are not a substitute for professional medical or psychological advice.
11.5 Participants with certain medical conditions, including but not limited to cardiovascular issues, respiratory problems, or pregnancy, are advised to refrain from participating in breathwork or ice bath programs. We are not liable for any complications arising from failure to disclose relevant medical information.
11.6 Participants are responsible for disclosing any physical or mental health concerns that may affect their ability to safely engage in breathwork or ice bath activities. We reserve the right to deny participation to individuals deemed unfit for these programs.
11.7 By enrolling in breathwork or ice bath programs, participants release BriannaJohnston.com from any liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, whether physical or mental, sustained during or after participation.
12. Force Majeure
12.1 We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, pandemic, epidemic, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disasters, or any other event that is beyond Our reasonable control.
12.2 In the event that a Party cannot perform their obligations hereunder as a result of force majeure for a continuous period of 4 weeks, the other Party may at its discretion terminate the Agreement by written notice at the end of that period. In the event of such termination, the Client shall agree to pay for all work completed up to the date of termination.
